SmartMargin provides a data analytics and performance tracking platform for businesses. The Platform aggregates data from various sources, including ERP, POS, Excel, and Access, to create performance dashboards and detailed reports. The specific features and functionalities are detailed in the Features section.

3. User Account

It is your responsibility to ensure the confidentiality of your account and login details. If you notice any unauthorized use of your account, please notify us immediately.

4. Data Usage

You grant SmartMargin a non-exclusive, royalty-free, perpetual, irrevocable, and worldwide license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display your data in connection with the Platform. SmartMargin will use your data solely for the purpose of providing the Platform’s services and in accordance with our Privacy Policy.

5. Intellectual Property

All intellectual property rights in and to the Platform, including but not limited to the software, design, and content, are owned by SmartMargin or its licensors. You may not copy, reproduce, distribute, or modify any part of the Platform without express written permission from SmartMargin.

6. Limitation of Liability

SmartMargin is not liable for any indirect, incidental, consequential, or special damages arising from your use of the Platform. SmartMargin’s liability is limited to the amount paid by you for the use of the Platform.

7. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the country we provide the service to.

8. Changes to Terms

SmartMargin reserves the right to modify these Terms and Conditions at any time. Updated terms will be posted on the Platform.

9. Payment Terms

The Platform is provided on a subscription basis. You agree to pay all applicable fees for your subscription to the Platform. Payments will be due on a every 25th basis, in accordance with the selected pricing plan.

• Late Payments: If payment is not received by the due date, SmartMargin may suspend or terminate your access to the Platform until payment is received.

• Refunds: All fees are non-refundable, except in the case of technical failure or termination of the service by SmartMargin.

10. Termination

SmartMargin reserves the right to terminate or suspend your account and access to the Platform at its discretion if:

• You breach any provision of these Terms and Conditions.

• SmartMargin is unable to verify the information you have provided.

• SmartMargin deems the use of the Platform by you inappropriate or in violation of applicable laws.

11. Force Majeure

SmartMargin shall not be held liable for any delay or failure to perform its obligations under these Terms and Conditions if such failure is due to circumstances beyond its reasonable control, including but not limited to, acts of God, war, terrorism, labor strikes, or technical failures.

12. User Responsibilities

As a user, you are responsible for ensuring that your use of the Platform complies with all applicable laws and regulations, including but not limited to data protection laws, intellectual property laws, and the laws of your jurisdiction. You agree not to:

• Use the Platform for any unlawful or unauthorized purpose.

• Infringe upon the rights of others, including intellectual property rights.

• Transmit harmful, offensive, or malicious content through the Platform.

Your use of the Platform is also governed by our Privacy Policy. By using the Platform, you agree to the collection, use, and sharing of your personal data in accordance with the terms outlined in the Privacy Policy.
